SwimPeaks Coaching provides personalized online swimming coaching services, including but not limited to:

Note: Services are provided on an application basis, and acceptance into any program is at our sole discretion.

3User Responsibilities and Conduct

As a user of our services, you agree to:

• •Communicate respectfully with coaching staff
• •Use services only for personal, non-commercial purposes

4Intellectual Property

All coaching plans, training materials, videos, and educational content are proprietary and exclusive property of SwimPeaks Coaching. You agree not to share, reproduce, distribute, or create derivative works from any materials provided without our express written consent. This includes but is not limited to training plans, technique videos, and coaching methodologies.

5Payments and Refunds

Payment terms will be clearly outlined in your individual coaching agreement. All fees are due as specified in your plan. Due to the personalized nature of our services and the immediate delivery of coaching materials, payments are generally non-refundable once a coaching period has commenced. Refund requests will be considered on a case-by-case basis within the first 7 days of service initiation.

6Health and Safety Disclaimer

Swimming and physical exercise involve inherent risks. Before participating in our coaching programs, you should consult with a healthcare provider. You acknowledge that:

• •You understand the risks associated with swimming and exercise
• •You have disclosed any relevant health conditions or limitations
• •You will follow all safety guidelines and use proper equipment

7Limitation of Liability

You expressly agree to assume all risks associated with participation in our coaching programs. SwimPeaks Coaching, its employees, contractors, and affiliates shall not be liable for any injury, damage, loss, or claim resulting from your participation in our services, including but not limited to physical injury, property damage, or performance outcomes. Our liability is limited to the amount of fees paid for services.

8Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. By using our services, you consent to the collection and use of information as described in our Privacy Policy.

9Termination

Either party may terminate the coaching relationship at any time with written notice. Upon termination, you will lose access to coaching materials and services. Any outstanding payments remain due. We reserve the right to terminate services immediately for violation of these terms or inappropriate conduct.

10Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these terms or our services shall be resolved through binding arbitration, except where prohibited by law.

11Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be communicated by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any modifications constitutes acceptance of the updated terms.
